Getting hurt at work can always raise your anxiety level. In today’s economy, not having a paycheck to meet your financial responsibilities is a terrifying thought. The first thing you need to do is find a trusted no-win, no-fee Arkansas Workers’ Compensation attorney to take on your case to ensure you get the full benefits to which you are entitled.

No-Win, No-Fee Attorney in Arkansas

For workers’ compensation attorneys, the fee structure works much in the same way that a personal injury case would work. This means that the attorney working on your behalf is working on a contingency basis. This means that if they do not win the case, you do not have to pay any fees.

Getting Ready for Your Free Job Injury Consultation

As you get ready to meet with local job injury attorneys to discuss your case, you should know your initial consultation is free. However, there could be a time limit on the initial meeting (expect an initial meeting to be about 30 minutes or less). Attorneys want to get as much information during that time as possible so they can to evaluate the case to decide if they are going to accept the case or not. That being said, you want to come to your consultation with as much information as possible.

In order to be prepared, have the following information with you:

  • All details of the accident
  • Copies of accident reports
  • Information for any witnesses to the accident
  • Current employee records
  • Recent pay stubs for income verification
  • Contact information for supervisor
  • Copies of all communications with employer related to accident
  • Name and address of the facility where the accident took place
  • Medical provider information
  • Copies of all medical records, including treatments received and all medical bills

The attorney will more than likely do most of the talking, but he or she will ask you if you have any questions before moving forward.

While you can certainly ask more questions, be sure to get these answered:

  • How long has the attorney been practicing law?
  • How long has the attorney been handling workers’ compensation claims?
  • What is the attorney and/or firms success rate in these cases?
  • Does the attorney handle more than one case at a time?
  • If yes to above, what is the current case load of the attorney?
  • Name and contact information of your direct contact if you are to work with attorney
  • Are there any fees you could be liable for if the case is lost?

Once you have secured an attorney, there are a few more questions that will need to be answered:

Arkansas Workers’ Compensation Attorney Fees

As is the case in many states, all attorney fees must be approved by the local board before they are charged. In Arkansas, that board is the Workers’ Compensation Commission. Fees are capped at 25 percent of the claim. The employer is also responsible for half of the attorney fees awarded, with the client being responsible for the remaining half. There are some exceptions to this rule, which your attorney can discuss with you.

Some of the contributing factors that will impact the approval of submitted fees to the Commission are:

  • Nature of the claim
  • Length of the claim
  • How long the claim took to settle
  • Complexity of the case
  • Benefits received in the case

Current Workers’ Compensation Rates in Arkansas

Effective October 3, 2022, the new workers’ compensation rates for 2023 will be a maximum benefit of $826 weekly for total disability and $626 weekly for permanent partial disability. Benefits are based on 66.67 percent of the average weekly wage (AWW) prior to the accident.

Should I Hire an Arkansas Workers’ Compensation Attorney?

Because these cases can get complex, we always recommend that you, at the very least, talk to an attorney. As we noted above, your consultation is free of charge, so you literally have no financial risk for sitting down to discuss your case. Nor are you forced to commit to an attorney for having a consultation. You may not like the first attorney you consult with but realize you need an attorney, so you are free to discuss your case with any other attorney until you sign a commitment letter with an attorney or firm.

If you would like to discuss your case with one of our attorneys, please give us a call at 855-633-0888.
